In a series of early morning tweets, Trump urged the Justice Department to ask for an "expedited hearing" at the high court and seek a "much tougher version" of the order temporarily blocking entry to the USA from a half-dozen majority Muslim countries. "The Justice Dept. should have stayed with the original Travel Ban, not the watered down, politically correct version they submitted".

Conway said the outcome at the high court "is what actually matters".

Mr Trump also found himself in hot water over his tough-talking tweets defending his ban on travellers from several Muslim countries, which is now stalled in the federal courts. He may realize that he doesn't have the votes on the Supreme Court to uphold his ban, so why not blast away?

The ACLU replied quickly, noting that Trump has "confirmed the ban is a BAN" while also conceding that the second executive order issued in March was substantively the same as the first.

"His tweets invite the question: if the second ban is 'politically correct, ' what is un-politically correct about the original?" Every sensible lawyer in WHCO [White House Counsel's Office] and every political appointee at DOJ wd agree with me (as some have already told me).

Trump had originally issued a policy that banned travellers from seven countries and halted the admission of most refugees.

Attorneys who sued are saying Trump's comments will help their case.

Less than a week later, Trump used the term "travel ban" on Twitter, and he has referred to it as such on multiple occasions since then.

Last week, the administration rolled out new policies for some people seeking USA visas who are deemed subject to greater scrutiny. He was recently the subject of media reports over his decision to withdraw from consideration for the role of chief of the Justice Department's Civil Division.

Trump has the authority to order the Justice Department to pursue a different strategy. The Supreme Court will hear oral arguments next week. Trump said in the first tweet.

In the states' brief, filed on Monday, Texas Solicitor General Scott Keller wrote that the executive order does not mention religion at all and distinguishes people based only on nationality.
