Speaking to NY1 Political Anchor Errol Louis, Cuomo said he will nominate appellate judge Paul Feinman to the state's Court of Appeals.
Gov. Andrew Cuomo said Thursday he will nominate mid-level appeals judge Paul Feinman for the state's top court, making him the first openly gay person to be up for the job.
If confirmed, he will be the first openly LGBT judge to the sit on the high court's bench.
Justice Feinman, who now serves on an intermediate state appeals court, would replace former Judge Sheila Abdus-Salaam, whose body was found in the Hudson River in April.

The Republican-controlled Senate will have to confirm Cuomo's nomination. He was also president of the International Association of LGBT Judges between 2008 and 2011, and headed the Association of Supreme Court Justices of the State of NY in 2015.
Feinman said the nomination is a "tremendous honor". He earned a graduate degree from Columbia University and a law degree from the University of Minnesota.
Additionally, Feinman has served on the International Association of Lesbian and Gay Judges and as president of the Lesbian, Gay, Bisexual and Transgender Bar Association of Greater New York.
State Senator Brad Hoylman, a Democrat who represents part of Manhattan and who is the only openly gay member of that chamber, called Feinman a "historic and inspired candidate".
"We are really squeezed", Bonacic said, noting the Senate has several other Cuomo nominations to consider before the session ends.
