Juror Claims There Were 2 Holdouts That Caused Bill Cosby Mistrial

One of the jurors from Bill Cosby's sexual assault trial told Channel 11 News that they didn't find alleged victim Andrea Constand believable, and the jury was hopelessly deadlocked from the beginning.

According to the juror who spoke to ABC News, the vote was 10-2 to convict him on charges that he digitally penetrated Constand without her consent, and 10-2 that he gave her drugs that substantially impaired her ability to resist.

But only one juror believed Cosby was guilty on the second count: That Cosby assaulted Constand while she was "unconscious" or while he knew she was "unaware that the penetration is occurring".

According to the juror, "there was no budging" from the holdouts - and things got incredible tense inside the tiny deliberations room.

As a result of the adamancy of the two jurors who found Cosby not guilty, a mistrial was declared.

Prosecutors say Cosby drugged and sexually assaulted Andrea Constand, the former director of operations for Temple University's women's basketball team, at his home near Philadelphia in January 2004.

ABC published the interview after Judge Steven O'Neill ordered the public release of the jurors' names, granting a request by a dozen media organizations, including The Associated Press and the major TV networks.

The judge released their names Wednesday but warned them not to disclose any votes cast by fellow jurors or anything said or done in the jury room that would indicate another juror's opinion.

The juror, who spoke with ABC News on the condition that they not be identified, said the the two jurors against Cosby's guilt on counts one and three were "not moving, no matter what".

The juror said the panel was "zeroed in" on Constand and "her actions" that night in Cosby's house.

Jurors also spoke in the deliberating room about how the prosecution was "political" and had been revived after several years, the juror said.

The juror recalled that at one point, one of the men punched a wall and may have broken his pinky knuckle.

"He openly admitted that what he gave 'em, he gave 'em pills", the juror said. The case ended in a mistrial when the jury was unable to come to a unanimous decision.

On Saturday, a Pennsylvania judge granted a mistrial after the jury had announced that they were deadlocked for the second time in the trial of Bill Cosby. "They had five sheriff's deputies at the door and they could hear us and they kept coming in because they thought we were already fighting", the juror said.

The juror added that the votes were 7-5 or 5-7 for much of the 52 hours of deliberations and described the grueling process as a "true deadlock" - contradicting a report Wednesday night from another anonymous juror that the vote was 10-2 to convict.

Prosecutors said they will retry the case.
