"First the Ninth Circuit rules against the ban & now it hits again on sanctuary cities-both ridiculous rulings". A federal judge on Tuesday said the president has no authority to attach new conditions to federal spending.
As The Associated Press points out, the court used some of Trump's own comments about sanctuary cities to determine the intent behind the executive order, including one where Trump called the order a "weapon" to use against these jurisdictions and another when Trump threatened to cut off all funding to California.
In the cases it accepted between 2010 and 2015, the Supreme Court reversed about 79 percent of the decisions that the Ninth Circuit Court of Appeals made. Trump did, however, correctly claim that 9th Circuit Court of Appeals decisions are overturned "close to" 80 percent of the time-but that only refers to the appeals court, not to all 9th circuit courts and not to the Northern District court.
The ruling by Judge William Orrick represents the third immigration-related executive order that has been blocked by judges in Trump's first 100 days in office. At least four of the nine Supreme Court judges must agree to hear a case, which come from the 50 state courts and 13 federal appeals courts, known as circuit courts. And they don't get to choose a judge; that's assigned through a system that more resembles a lottery. As Politico reports, the 9th Circuit will be the next court to rule on Trump's executive order as the legal battle continues.

THE FACTS: That's misleading.
Broadly speaking, the 9th Circuit includes the 9th Circuit Court of Appeals and district and bankruptcy courts in 15 federal judicial districts (among them Hawaii, and districts in Washington, California). According to Politifact, the Supreme Court overturns about 70 percent of the cases it accepts. But other circuits have seen their decisions overturned at a higher rate. An initial appeal heard by a three-judge panel in the Ninth Circuit Appeals Court also went against the current Justice Department, and the case remains there for more litigation.
In comparing courts' "performance", it makes more sense to compare reversal rate in terms of the ratio of cases reversed over cases reviewed by the Supreme Court, Hofer said.
