The production charge carries a minimum sentence of 15 years in prison, according to the Virginian-Pilot, which first reported the charges.

Seerden has since been charged with four felonies, including the production of child pornography, and U.S. Marshals are returning him to Virginia for his arraignment.

The SEAL does not now face any charges related to that allegation.

Petty Officer 1st Class Gregory Kyle Seerden is in federal custody in California, but his case has been transferred to the federal court system in the Eastern District of Virginia.

In a statement to The Post, Navy officials confirmed they are cooperating with authorities and that Seerden is an active duty service member assigned to a Naval Special Warfare Unit.

Federal prosecutors said investigators discovered graphic photos and videos of minors on Seerden's iPhone after a woman accused Seerden of sexually assaulting her in a hotel room on a military base while she was intoxicated.

According to the documents, she and Seerden had been out for drinks the night before.

The woman remembered that Seerden was on top of her at some point. She learned after waking up at 4 a.m. that they had sex, she said. When he dropped her off at the base's Gate 5, she told a guard.

Court documents say Seerden is a member of Seal Team One and was on temporary duty in Hampton Roads.

The documents show a NCIS investigation into Seerden's phone led to the discovery of images showing children performing sexual acts - as well as images an examiner indicated could possibly be linked to bestiality. At least one image also appeared to involve a naked child and aroused dog and another involved bondage.

A U.S. Magistrate judge in March 2017 authorized a search warrant permitting further investigation of the cell phone.

Agents said they found more than six dozen images. Although the man's face is not shown on camera, Seerden is seen wearing the same light-blue shirt in photos taken earlier in the night. According to court documents, other pictures from the same day show Seerden wearing a blue shirt. Seerden was serving temporarily in Norfolk at the time of the alleged assault, according to court documents. Court documents indicate that the family did not live in Virginia.

Court records don't list an attorney for Seerden. He identified Seerden's home state as Missouri.
