The bench also ordered that separate trial courts at Rae Bareli and Lucknow should be clubbed and conducted in the capital of Uttar Pradesh only and directed that trials should be completed in two years. On the other side, the cases related to the BJP leaders like LK Advani, MM Joshi and Uma Bharti which are taking place in Raebareli court.
The ruling came after a lower court dropped the charges brought against them by India's Central Bureau of Investigation (CBI), kicking off a series of appeals and counter-appeals. Advani and Murli Manohar Joshi had opposed transfer of their trial from Rae Bareli to Lucknow on the ground that proceedings against them would get delayed as there was 600 witnesses to be examined in the Lucknow case while there were only 51witnesses in their case.
At the time of the mosque's 1992 destruction, Singh was the chief minister of Uttar Pradesh.And was instrumental in the demolition of the mosque.
In September 1997, the CBI judge, perusing the composite chargesheet of the agency file in October 1993, had found prima facie evidence against 13 persons, including Advani and Joshi, for criminal conspiracy. The court even suggested that had the CBI done enough in 2001, the Supreme Court would not have been required to step in.
Summary: The AIMIM leader also expressed his apprehension over the Supreme Court giving temporary relief to Rajasthan Governor Kalyan Singh in this case.
Pronouncing the judgment, Justice Nariman said that since Kalyan Singh is now the Governor of Rajasthan and enjoys constitutional immunity from being prosecuted, the trial court would proceed against him the day he ceases to be Governor.

Restoring the conspiracy charge and transferring the trial, the judgment said, "What is being done by us today is only to remedy what was expected" to be done by the CBI and the then state government after the February 12, 2001 judgment of the Allahabad High Court.
It was also of the view that the conspiracy charges against the accused can not be dropped on the pretext of technical glitches and that it has stepped in to examine their restoration as the serious charge was originally in the joint charge sheet filed by the CBI in both set of the cases.
