White House spokesman Sean Spicer is declining to say whether Attorney General Jeff Sessions should invoke executive privilege in testimony to Congress Tuesday. He recused himself in March from a federal investigation into contacts between Russian Federation and Donald Trump's presidential campaign after acknowledging that he had met twice a year ago with the ambassador. Sessions recused himself from the Justice Department's investigation into Russia's interference with the United States election, but continues to head one of the nation's top law enforcement and administration agencies.
Sessions will testify before Congress at 2:30 pm ET on Tuesday.
But Chuck Schumer, the Senate's top Democrat, on Sunday said he would like that testimony to be before the Senate to help clear the "cloud" hanging over the administration in connection with the Russian Federation probe. "So I'm inviting him to come testify, and we could work that out", Schumer said on CBS.
And he can expect questions about his involvement in Comey's May 9 firing, the circumstances surrounding his decision to recuse himself from the FBI's investigation, and whether any of his actions - such as interviewing candidates for the FBI director position or meeting with Trump about Comey - violated his recusal pledge.
Comey also has said Sessions did not respond when he complained he didn't "want to get time alone with the president again".
"I would like to invite the president to testify before the Senate", Schumer said.

Kasowitz blasted Comey for leaking information about his private conversations with the president and said it would be left to authorities to determine whether the leaks should be investigated. According to long-standing Justice Department guidelines, contact between the White House and the Federal Bureau of Investigation is supposed to be routed through the attorney general or deputy attorney general to avoid the appearance of undue influence.
Trump on Sunday accused Comey of "cowardly" leaks and predicted many more from him. "I was honestly concerned that he might lie about the nature of our meeting, and so I thought it really important to document", the ex-FBI director testified.
During Comey's testimony last week, the former FBI director said he believed he had been directed to end an investigation into former national security advisor Michael Flynn.
Special Counsel Robert Mueller is putting together a first-rate legal team to dig deeper, and more hearings are coming on Capitol Hill. "Totally illegal?" he asked in a tweet.
Sessions' appearance before the intelligence committee is an indication of just how much the Russian Federation investigation has shaded his tenure.
